A Saskatchewan judge has ordered a new trial for David Ahenekew, the former aboriginal leader who was convicted of wilfully promoting hatred after he called Jews "a disease."
On Thursday, Court of Queen's Bench Justice Robert Laing ruled the trial judge, Marty Irwin, erred in his July 8, 2005 decision when he failed to take into account evidence suggesting Ahenakew did not intend to promoted hatred when he made comments about Jews to reporter James Parker in December 2002.
Ahenakew, a former head of the Assembly of First Nations, told Parker the Holocaust was a good thing and praised Adolf Hitler for having "fried" six million Jews during the Second World War. Parker is a journalist with CBC in Regina. At the time of the interview with Ahenakew, he was a reporter with the Saskatoon StarPhoenix newspaper. Later, Ahenakew apologized, but was charged with inciting hatred. Following a trial, Irwin found Ahenakew guilty and fined him $1,000. The amount was appropriate to prevent him from becoming a "martyr" for racists and bigots, Irwin said. In reading his verdict, Irwin said Ahenakew's comments "clearly dehumanize the Jewish people" and were exactly the kind of comments that laws against hate crimes were designed to address. Ahenakew appealed the decision.

Now we know, naming the jew is the same as shouting 'fire' in a crowded theater. Only a jew would attempt such a ridiculous stretch.
David Katzman, the president of the Congregation Agudas Israel in Saskatoon, said he was disappointed with the ruling.
"I thought that the evidence was clear," Katzman said. "Freedom of speech has its natural limits. People can't stand up in a theatre and shout 'fire.' And I don't think any one person can label another group as a disease."

I'M SO F****** TIRED OF ____ TELLING US WHAT FREEDOM OF SPEECH SHOULD BE. FUCK THE 'HATE LAWS'!!! THE ONLY REASON 'HATE LAWS' WERE IMPLEMENTED WAS TO PERSECUTE/MURDER WHITES WHO ARE TRYING TO PROTECT THEIR PEOPLE.
PEOPLE CAN AND SHOULD STAND UP IN A THEATRE AND SHOUT 'FIRE' IF THERE REALLY IS A FIRE. FIRE POSES DANGER. IT'S RIGHT AND JUST TO PROTECT YOURSELF AND YOUR PEOPLE FROM DANGER. SHOULD PEOPLE BE FORBIDDEN FROM CALLING CERTAIN GROUPS A 'DISEASE' IF THEY TRULY BELIEVE (AND MAYBE HAVE SOLID EVIDENCE PROVING) THAT THOSE GROUPS, FIGURATIVELY SPEAKING, ARE A 'DISEASE' DESTROYING THEM??? SHOULD IT BE ILLEGAL FOR PEOPLE TO PROTECT THEMSELVES FROM DANGER??? CANADA'S 'HATE LAWS' MURDER TRUTH.
