Argument Over Using Bathroom Sparks Fatal Shooting

CLINTON, N.C. -- A 16-year-old girl was killed early Saturday following an argument over using a bathroom, police said.

A group of five or six people stopped at a Sunoco at 1104 Sunset Ave. to use the restroom early Saturday, but the clerk didn't like them hanging around and asked them to leave, police said.

"When they didn't leave, she stepped outside, and that's when the actual verbal confrontation started," said Lt. Terry Miller, of the Clinton Police Department.

During the argument, two men drove up and one one started shooting at the group, police said. A bullet hit a 16-year-old girl in the neck, and she later died at Sampson Regional Medical Center, police said.

The girl's name hadn't been released by Saturday evening.

Flying bullets also hit two young men involved in the argument outside the gas station, including one who was hit several times in the chest and arms, police said. There was no word on their conditions Saturday evening.

DA Says Store Clerk Started Deadly Chain Of Events

After charging a man with first-degree murder last week in the shooting death of a Hobbton High School senior, Clinton Police now believe the real shooter is still on the loose.

Authorities are on the lookout for Lamar Demond Smith, 31, of 390 Cornwallis Road, Turkey, who is being charged with shooting 16-year-old Mercedes Lou Wilson in the head on the morning of Sept. 2 at a convenience store in Clinton. Hobbton High School's gymnasium was filled to the brim on Labor Day, for the popular teen's funeral.

Originally police arrested Ben Strayhorn Jr. of Clinton, but now he is being charged with obstruction of justice.

According to Dewey Hudson, the Sampson County district attorney, Mr. Smith is the only suspected shooter and is not in custody.

"Mr. Smith, who is an extremely dangerous and violent man facing capital murder charges, has not been apprehended," Mr. Hudson said yesterday during a press conference to update the community on the case. "Initially the police department charged Ben Strayhorn Jr. based on information they had. At that time they made the right call."

According to Mr. Hudson, Mr. Smith and Mr. Strayhorn look similar and were standing beside each other at the time of the shooting.

In addition, Clinton Police have arrested the clerk of the Sunoco station where the murder took place and charged her with obstruction of justice and accessory after the fact.

The incident took place just before 1 a.m. Saturday at the Sunoco on Sunset Avenue. According to Police Chief Mike Brim, an argument broke out between a female teenager and clerk Tijuana Michelle Lesesne, 28, of 40 Trailer Park Lane, Clinton.

The verbal disagreement, which was over the teen's alleged loitering in the store, spilled outside, where both Mr. Strayhorn and Mr. Smith were.

Lou, the 16-year-old Hobbton cheerleader, had entered the store to use the bathroom and was walking back out into the parking lot when Mr. Smith allegedly fired the shots.

One of the slugs struck the girl in the head and she was killed. Three more bystanders were injured.

Both Mr. Hudson and Chief Brim said Lou was an innocent bystander.

"It could have been anyone that came up to that store that night," Mr. Hudson said.

Mr. Smith, Ms. Lesesne and Mr. Strayhorn are all acquaintances, according to Chief Brim. The latter two were charged with obstruction after they allegedly initially lied about Saturday's events. Ms. Lesesne, who also allegedly refused to identify Mr. Smith, was charged with accessory after the fact.

Mr. Hudson said the clerk may have been the instigator of the whole event.

"There was no loitering by these children at all, contrary to what the clerk may have said," he said. "Two girls came in to use the bathroom and one of their friends made a purchase.

"We truly feel, because of (the clerk's) actions it led to the escalation of the event."

He said the entire incident, including the argument and shooting, took about seven minutes.

He said surveillance footage and other witness accounts led investigators to Mr. Smith, who allegedly opened fire indiscriminately at the group. Mr. Smith was sentenced to prison in 1994 on charges of assault with a deadly weapon inflicting serious injury after shooting several people in Duplin County (WTF, and he was out selling drugs within 7 years!), according to Mr. Hudson. He also served time in 2001 for selling schedule II drugs.

He is 6 feet tall and weighs about 180 pounds. Police say he may or may not have long dreadlocks (They have covered all the possibilities with this English). He may be driving a black BMW 740 IL with chrome wheels.

Ms. Lesesne was also convicted of assault with a deadly weapon inflicting serious injury in 2002 after an incident in Duplin County.

Chief Brim said the Labor Day weekend incident was a senseless act of violence, and encouraged anyone with information on Mr. Smith to come forward.

"We have already lost one child in this community due to his stupidity," he said.

The Wilson family, though grief stricken and in tears, attended the press conference to show their support for the Clinton department. Lou's older sister, Kim McLamb, remembered her lost family member.

"She was very energetic, she never knew a stranger," Ms. McLamb said. "She was more like my baby than my sister."

Lou's father, Steve Wilson, was choked up explaining how he named his daughter when she was born.

"I named her Mercedes after her mother and Lou after her grandmother," he said.

He said the violent act could have happened to any innocent bystander, which is why the killer needs to be found.

"It could be you, her, anybody's 10-year-old or anyone walking by the store," he said.
