(Oct. 26) -- The college football player fatally shot by police in suburban New York was struck three times, according to a news report.

Danroy Henry, a junior at Pace University in Pleasantville in Westchester County, was shot once in the shoulder and twice in the chest by police as he drove away from a brawl outside a restaurant early on Oct. 17, a law enforcement official told The Journal News.

Police say Henry ignored orders to stop and struck an officer. Other witnesses disputed that account, saying he thought he was following orders to move the car.

While two officers fired at the 20-year-old Henry, known as D.J., it was not known whose bullets hit him, the paper said.

The shooting is under investigation by local police, with assistance from state police and prosecutors.

The lawyer for Henry's family, Michael Sussman, asked U.S. Attorney General Eric Holder to have the Justice Department investigate Henry's death. The probe, headed by Mount Pleasant police, is "fatally flawed," he said, according to the paper.

Sussman also asked Westchester County District Attorney Janet DiFiore to back his request for an independent investigation, the paper reported. A spokesman for the Justice Department said it would monitor the local investigation, and DiFiore's office had no comment, the paper said.
