Some undocumented workers sue company that fired them

One of the immigrants who filed the lawsuit had a press conference Friday.

A group of undocumented former employees of a Houston restaurant are suing the company saying they were fired for not filing immigration paperwork they thought the company was taking care of.

Daniel Olivares said a few years ago, his company, a restaurant, came up with a deal.

He said the restaurant he worked for offered him a chance to become a legal citizen.

He said the restaurant would take care of the paperwork and all he had to do was pay for the legal fees.

Now, five years later, Olivares is not a U.S. citizen nor is he allowed to work.

Olivares has been in the United States illegally for 14 years.

He came here from Mexico.

For most of those years, he worked for Café Express.

For the past five years, he said Café Express took out $25 from every pay check.

He said that money was supposed to go to a law firm that would process the papers so that Olivares could gain legal status.

But somehow, Olivares said, the law firm messed up and missed the deadline.

Olivares said the company didn’t tell him until a few weeks ago.

That’s when his bosses at Café Express dropped another bomb.

“They just told me, ‘you’re fired and if you stay until the end of the month we’ll give you $200.’”, said Olivares. “I was in shock.”

That’s when Olivares got an attorney.

“This was the last best chance for this particular group of employees to become U.S. permanent residents and eventually U.S. citizens,” said Stan Broome. He’s Olivares’ attorney.

11 News was told 100 people are part of the class action lawsuit.

Some are filing separate lawsuits.

Wendy’s officials said the situation is unfortunate, but they can’t do anything about it. They went on to say, this was all done before Wendy's owned Café Express and that they no longer use the law firm Café Express used to use.

The people who filed suit can no longer appeal the process. They can no longer be U.S. citizens.

They only thing they can do, officials said, is sue for money which is what they’re doing.
