Officer Roberto Garza Jr. is accused of violating the civil rights of a 16-year-old when the lawman allegedly used excessive force during the arrest of the teen in March 2003 following a police chase.

Garza, a five-year veteran of the force, allegedly punched the handcuffed juvenile and hit the teen with his knee, the release said.

Another police officer witnessed the incident and reported it to his superiors.

A federal grand jury indicted Garza on Tuesday and he was arrested on Wednesday.

If Garza is found guilty, he faces up to 10 years in federal prison and maximum fine of $250,000

That seems a bit stiff. Hell, in New Mexico a cop can execute an unarmed,
handcuffed man, all caught on video/audio, and only receive a year in prison.

He RIGHTFULLY(if not legally) executed a idiot that murdered two other people and probably would have done the same to the child and the other cop too.

This cop (Otero County Sheriff's Deputy Billy Anders) is definitely a certified HERO and certainly does not deserve any prison time what so ever.

I'd like to think I would have done the exact same thing,given the circumstances.

Unfortunately,most people foolishly believe that the "Law" is a game of rules;and that cops are bound by an oath to obey these arbitrary rules even when their life or the lives of other are at stake.

Execution was ineffable for Earl Flippen;Anders only real crime was acting too quickly.Now he'll pay for taking the law in his own hands-for a year.But he'll still be a hero- for life.

It takes a REAL HERO to act (and place himself in the breech/even above the law) as Anders did; and go outside the law he had enforced for 31 years;knowing that he would suffer the consequences that he faces now.

If more REAL police would act more like Anders did; and exterminate the filthy creatures on the spot,far far fewer criminals would feel less careless or brave to even consider such acts as Flippen did.

Murder is never a pleasant deed,but when appropriate;it's a very special man who actually has the real courage to act in a manner really befitting a REAL white-man.

Jim,I'm sure this is not the reaction you desired to your article,especially with Flippin being a "supposed" white supremest;but I was a cop for over 35 years and actually faced similar circumstances as this... and .......thank goodness; that was in a day, way before video cameras.
