"Serial Killer Trial"
A year and a half ago, alleged white supremacist and serial killer Joseph Paul Franklin got to meet his pen pal, a prosecutor and part-time model from Cincinnati, Ohio. As a result of that meeting, Franklin -- who is already on death row -- is back in court facing another life sentence.
From an attorney-client conference room at the Potosi Correctional Center in Missouri, Franklin confessed to assistant prosecutor Melissa Powers that in 1980, he killed two teenage boys because they were black. Powers had been assigned to the case after it became apparent that Franklin would only talk to female prosecutors and reporters.
Powers recorded the conversation for fellow prosecutors to use in their quest for an indictment against Franklin.

According to the prosecution, Franklin told Powers that he was out to cleanse the world by killing blacks and that he picked the Bond Hill site in Cincinnati because it was a racially mixed neighborhood. On June 8, 1980, he allegedly set up his high-powered rifle at a railroad trestle within shooting range of a convenience store. When he spied 14-year old Darrell Lane and 13-year old Dante Evans Brown, who had ventured out in the dark to buy candy, Franklin opened fire. Lane was shot through the chest and died at the scene; Brown died three days later.
On April 28, 1998, Franklin pleaded not guilty in a Hamilton County, Ohio courtroom. Franklin is serving as "co-counsel" in his defense.
Dale Schmidt, Franklin's attorney, filed a motion to suppress the confession on the grounds that Powers violated Franklin's rights by failing to tell him his statements could be used against him in court. Schmidt also suggested that Powers misled Franklin by "leading him on" in order to obtain a confession.
Powers first contacted Franklin, who is on Missouri death row for the murder of a Jewish man outside a synagogue, on April 10, 1997. She sent him a hand-written note and a photograph of herself.
Franklin agreed to meet Powers on his birthday, three days later. Reportedly, he refused to schedule the meeting on April 20 because he would be celebrating Adolph Hitler's birthday. Powers and Franklin met for five hours.
On October 1, 1998, prosecutors won a crucial victory when Judge Ralph Winkler ruled that the confession was admissible. Winkler ruled that Franklin was willing to talk to Powers, invited her to visit him at the Missouri prison and knew that his statements could lead to criminal charges. The judge also stated, "there is no constitutional right to an unattractive interviewer."
While the defense's motion to suppress the confession was denied, the argument that the statement was improperly taken by Powers will be resurrected for the jury.
According to a document prepared by the prosecutor's office, Franklin has been linked by indictment or confession to 20 murders, 6 serious assaults, 16 bank robberies and two bombings in 11 states. Franklin's shooting victims have included civil rights leader Vernon Jordan and Hustler magazine publisher Larry Flynt. Franklin also has confessed to the 1980 West Viginia "Rainbow Murders" of two women who were hichhiking to a hippie festival. Another man, Jacob Beard, is serving two life sentences for this crime.
