Place a generic disclaimer sticker on the product.

There's a disclaimer at the beginning of the film that sates: "The views expressed in this documentary film are solely those of each individual"

I honestly don't know how to make that any clearer.

Indeed. He's grandstanding for all his associates on the hill. This letter is no doubt a response to the congressional mass mailing Yggdrasil and I sponsored earlier this month.

I can't believe this! :confused: How does Congressman Tancredo expect to benefit politically by asking to be disassociated from the film? He's already damned by the "Open Borders" crowd anyway because of his strong immigrant reform stance. He's acting like another Trent Lott. I thought he might be a worthy alternative choice for President in 2008, but if he's that afraid of being labelled "racist", then who needs him?

The way the Congress works is that the various congressmen are given "roles" and Tancredo is the resident "anti-immigration" guy that is put before the American public to deceive them into believing that there is actually a debate about the issue and that the anti-immigration sentiment among the majority actually has an advocate in high places.

You can see this at work when the Congress uses the nigger congo-men to make "statements" regarding nigger issues. The niggers are supposed to be happy that a fellow nigger is complaining about the issue to da Man from high places, but that is only a ruse as well.

Recently, a nigger congoman stated that New Orleans might never be majority nigger again. This government statement was presented to the public in the form of a complaint by a concerned nigger citizen and public servant. In reality, it was just a statement that the government planned that New Orleans was not going to be majority nigger again presented in a way that made it look like the government was concerned about this unfortunate consequence of the hurricane.

This is the only explanation for why an "anti-immigration" politician distances himself from any real advocacy of that position. His role is to fill the void of any real anti-immigration action so the appearance of democracy is upheld before the citizenry without any real change in the course that the ruling elite have chosen for us.

This is exactly right. You'd be surprised how many folks, even among the jew-wise, still don't understand this.

This is ridiculous. Congressman Tancredo is about as private as Dubya and his segment of the film was shot at a public press conference, held by a public figure discussing public policy in public. Privacy tort laws therefore do not apply. Especially to such a media whore as Tom Tancredo.

This letter is a piss poor attempt at intimidation and sure as hell wouldn't stand up in court. If Mr. Tancredo doesn't like media he doesn't agree with using his image (which would be most mainstream liberal tv networks and Spanish language television), I suggest the Congressman stop giving public speeches and press conferences.

We should not be surprised. There is not one politician in Washington that would not get on his knees and lick the dogshit off of a Kike's shoe. It truly is amazing that there is not one politician anywhere in this country who would speak up on behalf of European-Americans. We should never forget that, especially when there is a reckoning for what has been done to us.

In response to this heavy-handed attempt at censorship, I've sent an e-mail to the O'Reilly Factor. The objective is to get some mainstream publicity for October Sun Films and to put heat on Tancredo.

Dear Bill,

I have reason to believe that Congressman Tom Tancredo (R-CO), heretofore a stalwart supporter of immigration reform, may be wavering in that commitment.

Recently, the U.S. House General Counsel sent a "cease-and-desist letter to October Sun Films, the producer of the critically-acclaimed "The Line In The Sand" documentary. The letter claims the film does not represent Mr. Tancedo's views. Since the film advocates immigration reform, are we to conclude that Mr. Tancredo now favors open borders?

I have included, in following paragraphs, a copy of the letter itself, as well as pertinent websites where you can obtain further information.

Up until now, Congressman Tom Tancredo (R-CO) has led the fight for immigration reform. However, he now appears to be wavering in that commitment.

Re: The Honorable Tom Tancredo

Dear Mr. Jost,

I write on behalf of the Honorable Tom Tancredo, U.S. Representative for Colorado's 6th congressional district. It has come to our attention that you have used video clips of the Congressman in a film you directed and produced entitled "The Line in the Sand", which is being sold and distributed through October Sun Films. Your use of the video clips of Congressman Tancredo appears intended to suggest that the Congressman endorses the comments or message of your film. Congressman Tancredo does not, in fact, endorse the contents or message of your film, nor has he authorized or consented to your use of these video clips in your film.

You should be aware that your actions may violate tort laws which create causes of action for invasions of privacy. D.C. law, for example, firmly establishes the tort of "appropriation" of (another's) name or likeness." Tripp v. U.S. 257 F.Supp.2d 37, 40 (D.D.C. 2003) (citing Restatement of Torts 2nd, 652C(1977). According to section 652C of the Restatement, "one who appropriates to his own use or benefit the name or likeness of another is subject to liability to the other for invasion of privacy." See also Cox v. Hatch, 761 P.2d 556 (Utah 1988); Utah Code Ann 45-3-3, 76-9-407 (2005). In this case, you have appropriated Congressman Tancredo's likeness for your own benefit in an apparent effort to advance your own views.

For these reasons, as well as the Congressman's desire not to be associated with your film, you must immediately cease and desist from distributing any copies of your film that contain video clips of Congressman Tancredo. In addition, you must refrain in the future (1) from using any video clip, photograph, or likeness of Congressman Tancredo without his express written consent, and (2) from representing or implying that Congressman Tancredo endorses either the content or message of your film.

Analysis:

1. First, this is a heavy-handed attempt by a powerful Congressman to intimidate a small businessperson.

2. If Congressman Tancredo does not endorse the "message" of the film, this implies he no longer favors immigration reform, since the message of the film is about immigration reform.

3. This causes October Sun Films financial harm. There was no way they could have expected to know the Congressman's "sudden" expectations in advance.

4. It appears that Tancredo wants to use this letter as a prop to wave in the face of the Open Borders crowd to prove he's not a "racist". It will not work; the Open Borders crowd considers anyone who opposes open borders to be a racist. So why throw away the paleoconservative vote and the White Nationalist vote to try for votes he can't get anyway?

I sent an e-mail to Tancredo's blog on Saturday. I've received no reply. If you are equally outraged by this, contact Congressman Tancredo at his website or communicate with the General Counsel using the following address:

Dear Ms Gennet:

I am advised by counsel to reply to your letter to me of October 18, 2005, written on behalf of Congressman Tom Tancredo, by reminding you that the Congressman is a public figure, and that the privacy of a public figure cannot be invaded, in any actionable manner, by reproducing comments he makes at a public press conference.

As to common law and statutory “rights of publicity,” those causes of action apply to the appropriation of an image of another without permission for purposes of advertising a product or service. We find a number of cases which hold that the inclusion of images or clips of celebrities or public figures in documentary movies as part of the substantive content of the movie are not within the scope of these statutes, and that application of these statutes to such substantive uses would interfere with important first amendment rights.

Given that the film opens with the prominently displayed statement that “the opinions expressed in this documentary film are solely those of each individual...” it is difficult to understand how any reasonable person could conclude, as you claim in your letter, that “[y]our use of the video clips of Congressman Tancredo appears intended to suggest that the Congressman endorses the contents or message of your film.”

A more reasonable inference to be drawn from my inclusion of clips of the Congressman is that I approve of the Congressman’s views - which, of course, is the fact. Indeed, I admire Congressman Tancredo’s courage for his positions on illegal immigration and as a courtesy to him, I included his remarks at length and un-edited so as to prevent any confusion on the part of fair minded people about what he thinks.

I am well aware that those who wish him harm will falsely accuse him of grasping the politically forbidden “third rail” of group competition and conflict - a “third rail” which two or three other individuals appearing in the movie enthusiastically grasped with both hands.

But I am comforted by the receipt of your letter which indicates that the Congressman is taking steps to preempt any such political attacks.
