I need an attorney or a competent legal assistant to do the draft (or actual lawsuit). I'll type the thing, and file it pro se at the federal courthouse in Springfield, MO.
All pertinent information supporting the grounds for this lawsuit is contained in my US Senate campaign thread.
Several Missouri radio companies, representing more than 60 radio stations, have flat refused, in writing/via email, to broadcast my paid campaign commercials. On 16 April, the Missouri Broadcasters Association filed a petition asking the FCC to issue a declaraory ruling on the issue of whether I am a "bona fide" candidate and therefore entitled to mandatory access to Missouri's broadcast airwaves.
Consequent to the petition, and the mass media coverages of it, all but a few Missouri stations have emailed me stating they will not broadcast my campaign commercials until after a ruling by the FCC.
The FCC has not issued a ruling as of today (15 Jun 2010), which is 2 full months since the petition was filed and almost 2 months since several radio companies either stopped broadcasting my commercials, or else emailed me stating they didn't intent to until after the FCC's ruling.
I phoned half a dozen local civil attornies, but none are interested in taking the case on contingency. I also emailed the St Louis ACLU asking them to take the case, but they did not respond by phone or email.
The case is very simple, in my opinion. The MO radio companies are in violation of federal election law - Section 73.1940 [47 CFR 73.1940].
The lawsuit should therefore be kept short and simple, thus far less vulnerable to spins and legal wrangling BS that will result in the lawsuit being thrown out on a minor technicality.
So, who'll do the freakin lawsuit and post it here for critique and for approval ???
