DURHAM, North Carolina (CNN) -- Defense attorneys for two Duke University lacrosse players charged with rape are questioning the process by which the accuser identified her alleged attackers, a source close to the defense told CNN Friday.

Under the procedure, the accuser was shown images of the team's 46 white players and told they were people police suspected were at the party, the source said.

The defense will likely file a motion to suppress the identification because no pictures of non-team members were included in the presentation, the source said.

Legal experts told CNN that authorities would not necessarily be required to show pictures of unrelated people with pictures of the lacrosse players.

District Attorney Mike Nifong did not return a call seeking comment on the identification procedure.

On Friday, Robert Ekstrand, an attorney for dozens of the uncharged lacrosse players, said authorities have given the defense team a copy of the police report on the photo identifications made by the accuser. Ekstrand said according to the report, the accuser was shown photos of 46 lacrosse players and was told by police that all were believed to be at the party.

Ekstrand said the police should have included photos of people not linked to the case.

"There weren't any dummies in there," Ekstrand said. "There weren't elements to test her, like someone known not to be near the party or involved."

Nifong's office said Friday the prosecutor, as he has for several weeks, would not comment on the case.

A dancer at the Duke lacrosse party where another hired escort reported a gang rape was arrested on a probation violation immediately after giving a statement to police about that night.

Kim Roberts, who danced with the woman who said she was attacked, was released on a $25,000 secured bond March 22, the day of her police interview.

On Monday, the day two lacrosse players were charged with rape, District Attorney Mike Nifong downgraded Roberts' bond to unsecured status, releasing her from the obligation to leave the money with the state -- bondsmen usually charge a 15 percent commission for this service -- or put up collateral.

Defense lawyers for the lacrosse players have said Nifong gave Roberts special treatment by downgrading the bond, which Nifong denies.

Roberts' "attorney requested that I do that and because I did not think that any of the reasons for pretrial release were served with this person remaining in custody," Nifong said. "That kind of thing happens every day."

DURHAM - Defense lawyers and legal experts say District Attorney Mike Nifong may have crossed ethical lines in public comments about rape allegations involving Duke University lacrosse players, potentially prejudicing jurors and setting off a media maelstrom.

For his part, Nifong says that he has done nothing wrong, though he has ceased talking with reporters about allegations made by an escort service dancer hired to perform at a March 13 team party. He would speak only about his handling of the case Friday.

"In terms of what I said, no, I wouldn't say I regret anything I've said," Nifong said. "I think what I have learned, basically, is that if you cooperate with the media out of a sense of duty to public truth, you make yourself a victim."

There have been high-profile criminal cases in the Triangle before, but local observers were hard-pressed this week to remember a case with so much back-and-forth between the prosecution and defense playing out in a 24-hour news cycle. It has some suggesting a judge should step in with a gag order.

Defense attorneys for the lacrosse players say it is their clients who have been victimized by Nifong, and they blunt criticism of their own extensive public comments by saying they are just attempting to limit the damage.

Some also said photos, ATM receipts and other evidence they claim exonerates the two team members arrested Tuesday were given to the media only after Nifong refused to look at them.

AP) DURHAM, N.C. Several Duke University alumni questioned the school's president Saturday about suspending two lacrosse players charged with raping a stripper at a team party, with one saying his alma mater is guilty of "a tremendous rush to judgment."

"It was convenient to throw the lacrosse team overboard along with their coach," said Joe Baden, a 1970 Duke graduate from Raleigh.

Baden was among about a half dozen alumni to question President Richard Brodhead during a forum held as part of a weekend of class reunions. During a talk about the school's strategic plan, Brodhead stopped the program for a half hour to specifically take questions from the crowd of nearly 100 about the lacrosse team and the rape allegations.

Duke has not confirmed it suspended the two players charged with rape, although the university has said the school's practice is to issue an interim suspension when a student is charged with a felony or when the student's presence on the campus may create an unsafe situation.

Baden wondered whether Brodhead would have done the same if men's basketball coach Mike Krzyzewski, who has won three national titles, was at the center of the scandal.

"Would he have shut down the basketball team if precisely the same allegation was made by precisely the same person?" Baden asked. "I don't think they would have."

By accusing the Defense of fabricating evidence he's swinging hard and hoping against hope that he hits something; and he's gonna miss. Digital pics are easy to fabricate, but in this case it will be easy to determine the truth of the matter. Computer forensics will very quickly determine how the original picture was taken and statistical analysis of the digital file can determine if any alteration was made. Since this is taking place in RTP, there are hundreds of people within a one mile radius of Duke campus who could do the analysis quite easily.

Eyewitness News reported Thursday about the group offering security to the alleged victim in the Duke lacrosse case. They also were planning to hold a news conference Monday on the Duke campus.
But the group has not yet filed a permit application with the Durham Police Department. Duke officials have issued a statement saying they will not allow any disruptions. The group is not allowed in academic buildings to residence halls.

Both the Durham Police Department and the New Black Panther Party declined an on-camera interview. But a representative speaking on behalf of the group's leader tells Eyewitness News that contrary to reports, they will not be armed when they arrive on campus. In their words, it will be a "peaceful protest."

Eyewitness News has learned that the group wants to march to the lacrosse field and the house where the alleged rape occurred. Some students say it would not be a distraction as they get ready for Monday's final exams.

"I feel like so much has gone one that we've pretty much gotten use to all the news vans and protests," said student Sarah Wallace.
