As those of you who have been on our e-mail list, Brush Fires On Line, we are helping Order Pow, political prisoner and LibRA member Gary Yarbrough fight a legal battle for justice over the brutal beating to which he was subjected by guards in USP Atlanta. We have previously sent out reports, and an appeal from Gary himself for help in this battle. Those of you on this list who may wish to write to Gary may do so at:
Gary Yarbrough, 09883-016
USP ADX
PO Box 8500
Florence, CO 81226
Gary was placed in a holding cell while shackled and handcuffed. While restrained, he was brutally and savagely beaten by guards. He was unconsious for at least two hours (for a hefty fee we can obtain a copy of the surveillance video of Gary in the medical ward--and also a copy of the surveillance video showing the range on which the cell in which Gary was placed, with the guards all ganging up outside the cell, "affirmative action" goons all laughing and jeering). Gary was transported to an outside hospital due to the seriousness of his injuries. He was confined to a wheelchair for three months after this, because of injuries from the beating.
We recently obtained photocopies of photos taken as part of the Federal Bureau of Prison (BOP) "use of force report." These photos were taken while Gay was lying unconsious in the prison's medical ward. Gary has asked me to share these photos with you. The photocopies of these pictures aren't very clear, but they do somewhat show some of the profuse bleeding by Gary from head injuries, his bruises and cuts, and clearly shows the state of unconsiousness he was in. Hopefully the attachments will come through alright. Look at these photos. This is the atrocity for which we are seeking justice not only on behalf of Gary, but also on behalf of all of our political prisoners. Having completed the statutory requirements of the Federal Tort Claims Act (through which the BOP could have settled, since they cannot win in court), we are helping Gary prepare to file this as a formal civil rights action in federal court. (Instead of doing the right thing, the BOP resorted to a retaliatory transfer to a supermax, even though his security score qualifies him for a lower security level FCI--and before long we will be sending out information on protesting this act to correct it. Outside pressure got him finally transferred from Atlanta, and it can help get him out of supermax to a lower security level prison for which he qualifies and deserves.)
Our political prisoners are almost always subjected to harassment or retaliation in some form or another, some more serious, some less serious, than others. But the brutal beating to which Gary was subjected--by guards--took this abuse, this retaliation, to another level. To a level we can not, must not, should not tolerate. Letting this go unchallenged would inevitably place every other political prisoner in danger of being victimized by a similar or worse atrocity.
This legal battle will be among the most important battles anyone who considers themselves to be pro-Eurofolk will fight this coming year--if not the most important, the most serious. If you want to finally be part of and help in a real battle, with a real potential for victory (the BOP cannot win on the merits of the case), which will accomplish something real and worthwhile for a change, your help is needed.
