Nationalist Movement leader "Wacky" Dick Barrett has won a major lawsuit against the City of York, Pennsylvania, despite being a fringe fruitcake within the white nationalist movement.

Today, the US 3rd Circuit Court of Appeals ruled as every other Court of Appeals and the Supreme Court have done, and threw out the remaining provisions of a York, Pennsylvania law that requires white activists holding demonstrations to reimburse the city for the cost of policing political demonstrations and to pay an application fee upfront. Previous requirements for white activists to post an insurance bond and other limitations were overturned at the District Court level.

"Given the substantial expense that could be levied upon a speaker, and the almost limitless possibility of abuse, it is an understatement to conclude that this provision chills constitutionally-protected speech," U.S. Circuit Judge Maryanne Trump Barry wrote in today's ruling, "In deciding how best to police the event and charge the speaker, the city is given unlimited discretion which could easily be used to punish (or intimidate) speakers based on the content of their messages."

With that issue settled, a claim by Barrett for reimbursement under the 1976 Civil Rights Act, which awards twice attorneys fees to the prevailing party in civil rights litigation, will go forward. Barrett is reportedly claiming $160,000 or more in attorney's fees so far, and the City of York is likely going to be forced to pay Barrett $320,000 or more for the illegal ban.

The City of Boston previously paid Barrett $70,000 after it lost similar litigation. The 1976 Civil Rights Act has created a cottage industry of attorneys who sue based on alleged civil rights violations, but Barrett is the only white nationalist attorney known to regularly take advantage of it.

Other small cities across the country have tried similar illegal measures to stop or limit white rallies, leading to similar lawsuits and judgments.

Richard Barrett is unpopular in the white nationalist movement because he is a chronic liar and a bit of a kook. Previously, this website has had to file actions against Barrett with the Mississippi Bar to stop a campaign of harassment and abuse of his position as an attorney. Though Barrett has ceased the behaviors complained of, he continues to publish untrue statements about a variety of white activists on his nationalist.org website.
