Court says oral sex law violates rights

SAN FRANCISCO (Reuters) - A 22-year-old Californian man who received oral sex from a sixteen-year-old girl should not be forced to register for life as a sex offender, the California Supreme Court ruled on Monday.
The state's top court found that California denied Vincent Hofsheier equal protection under the law because those having intercourse in such circumstances would not be forced to register as lifetime sex offenders.
Hofsheier appealed after being ordered to register his name on the list, which is shared with the public and carries significant stigma.
"Requiring mandatory lifetime registration of all persons who, like defendant here, were convicted of voluntary oral copulation with a minor of the age of 16 or 17, but not of someone convicted of voluntary sexual intercourse with a minor of the same age, violates the equal protection clauses of the federal and state Constitutions," the court ruled.
"We perceive no reason why the legislature would conclude that persons who are convicted of voluntary oral copulation with adolescents 16 to 17 years old...constitute a class of 'particularly incorrigible offenders'... who require lifetime surveillance as sex offenders."
U.S. law on oral sex has evolved over the years, and it was not until 1975 that oral sex between consenting adults was decriminalized in California. Today, in 38 of the 50 U.S. states consensual sex with a 16- or 17-year old is legal.
In the case, Hofsheier pleaded guilty and received probation after meeting the teenager in an Internet chat room and sharing rum and orange juice with her at a beach.
The California Supreme Court's decision returns the case to a lower court to decide whether he should still be subject to registration under that court's discretionary authority.

I fail to see why you should condemn oral sex in this way.
There is evidence that it was regarded by the ancients as a sacred act and could enhance vitality and fertility.

you gotta love the new party line, which is outrage over 'sex offenders'.
Meanwhile, our national policy towards the muslim world is to rub our own fornication, adultery, homosexuality in their face, and provoke them. I'd say Americans are sexual 'offenders' in general. These noble people would rather kill their daughters than have them fornicate and have bastard children out of wedlock. Oral sex --- no problem whatsoever.
Sex with a 16 year old girl --- possible big problem.
22 year old kid having consensual sex (oral or otherwise) with a 16 year old girl. --- Hmmm, irresponsible.
If he were 32, I'd say toss him in the can for 6 months. 22 year old boy? Hell, scare the crap out of him and tell him to wait until the girl is 18 or whatever the age of consent is.
I had a 17 year old girl friend when I was 22. I guess I should go register somewhere. Is there a statute of limitations on this.

Oral sex, associated with fag prostitutes from time immemorial, is just one more Western taboo broken down by the jews through media aimed at the younger generation. The older generation considered it sickening, so through bubble gum rock, etc, they introduced the ideas to pre-teens. In this way they can subvert a population's moral backbone and program in anything they want. Then oral sex was considered "too weird". Now it is considered normal. The acceptance of oral sex as normal was part of the campaign for homosexual acceptance, and it is now part of the campaign for 'sex with kids' acceptance.
Of course, the evil is good crowd won't understand...they are too far gone.

In previous generations many 16 year women would have been married with children of their own. A 16 year old female is sexually mature (and almost as mentally mature as a woman is ever going to get).

There's something deeply weird about someone calling himself "Abzug Hoffman" who goes around accusing just about everyone else of being a Jew. Then you throw in the obsessive Fundy Xtianity and sexual obsessions on top of that, and you've got quite a mess.
Our problem today isn't people having oral sex. Anyone who thinks that we only "discovered" oral sex during the Sexual Revolution of the 1960s is naive. What we need is not a return to Victorian attempts to suppress sexuality, but rather a toning down of the sexualized media content that is constantly pumped into our collective consciousness by the usual suspects. Have all the sex you want, just let's find something else to talk about in public, please.
