Earlier today, I found an interesting article in Spectator Online about this subject. The author, Austin Burton, actually wants to do away with all Rape Shield Laws period. I've excerpted the most pertinent part below; click here for the full article:

Kobe Bryant is not the first pro basketball figure to be accused of illicit bedroom behavior.
In 1998, legendary NBA broadcaster Marv Albert pled guilty to misdemeanor assault and battery, stemming from an incident that took place during a sexual encounter with his mistress. Albert had to plead guilty, in part, because although the victim in his case had a history of falsely accusing men of sexual assault, that evidence was not permitted in court due to rape shield laws.

In 1978, our Congress passed Rule 412 of the Federal Rules of Evidence; better known as the Rape Shield law. Since then, 49 of the 50 United States have adopted identical or similar laws, which vary in practice from state-to-state. In Colorado, where Los Angeles Lakers star Kobe Bryant faces rape charges, they are among the harshest in the country.

What rape shield laws do is limit defense lawyers in rape trials as far as bringing the alleged victim’s sexual history into play. The laws are intended to prevent the alleged victim from having their credibility attacked and their reputation sullied with information that supposedly has nothing to do with the case at hand.

But what if that information does have to do with the case? Shouldn’t defense attorneys be allowed to adequately defend their clients? For that and other reasons, rape shield laws are unjust and the lawmakers in this country should get rid of them. Rape shield laws are outdated, no longer necessary and ultimately unfair to those men (and women) accused of rape, some of whom are actually innocent.

In the 1970s, when rape shield laws were enacted, sex wasn’t as openly discussed or accepted by mainstream society as it is today. The idea that a woman who engaged in consensual premarital sex at one time in her life would have any and all future allegations of rape automatically discredited isn’t realistic anymore. As much as people may deny it if you asked them, society has accepted that many people become sexually active in their teenage years.

One major flaw within rape shield laws is that while the alleged victim’s sexual past remains a closely-guarded secret, the alleged rapists’ past can—and often will—come up in court.

Aren’t defendants supposed to be presumed innocent? In our legal system, the burden is on the government to prove that the criminal charges levied against someone are true beyond a reasonable doubt, with the jury assuming that the defendant is innocent until proven otherwise. However, by enacting rape shield laws and safeguarding the past of the alleged victim, an inherent assumption arises that the woman is indeed a victim, which then of course implies that the defendant is guilty; seeing as you can’t have a “victim” unless there is a crime.

Interesting analogy. Burton correctly cites the change in sexual mores since the 1970s, when a publicly promiscuous women was automatically considered a "fallen" woman. The Rape Shield concept framed at that time reflected those standards. His premise is they don't satisfactorily reflect the current standards. He also makes an excellent point about inconsistency; the plaintifff and the accused are no longer on a level legal playing field.

However, the original premise that a female rape victim should not also be put on trial simply because she has a normal, healthy, consensual love life still stands. Promiscuity by itself should not be a factor. The problem in the cited cases was not that the plaintiff's previous love life was made public, but that previous false rape charges were not admissible. If a purported rape victim has filed false charges in the past, this is totally germane to the case, should be disclosed to the jury, and should be considered during deliberations. So rather than get rid of Rape Shield Laws, simply narrow their scope to exclude previous sexual history but include previous instances of false charges filed.

As Diane said, the liars make it harder on the real victims. So there must be a disincentive against lying.

The problem is that laws protecting women against rape were created in a different era when very few women were the slutty, manipulative psychotics they are today. So back then when a woman said she was raped she was truly raped.

Today a lot of women just charge men with rape to feel "empowered" or to get back at a symbolic Daddy figure who ran out on the family (this vengeful female behavior is another product of broken homes and the high divorce rate in this country, it causes women to hate all men because they are identified with the Dad who abandoned her and Mom)

I do not think in most cases it is neccessarily that psychological. I think they either had sex with someone, regret it, feel like a cheap slut and now are trying to make excuses for their behavior or maybe they were stupid and jumped in bed with some guy, who was ONLY looking for sex and they get pissed and want to "get back at him" for treating her like what she is.

The reason they regret it is that women seem to place all of their ego in their vagina which perhaps is a survival instinct/biological issue for them, but still if it is THAT important they should stop being so damn promiscuous.

Women are able to place their egos in their vaginas because it's obvious that their vaginas are valued by men. If men were as eager to gain access to any other body part as they are the vagina, then women would start placing their egos in those other places as well.
