A bizarre case in Cincinnati, Ohio will see a homeless man stand trial for allegedly raping a 23-year-old woman - while she was sleepwalking. The unnamed victim is a university student who suffers from epilepsy and is given to going on nocturnal journeys while she's fast asleep.

She was out on one of her unconscious walks around 3:30am November 8th when cops allege 52-year-old Dexter Ford saw her and decided to take advantage of her helpless state. Passing motorists called police after seeing a woman being attacked at the side of the road. The victim apparently woke up during the incident but was unable to fend off the man she found on top of her.

The alleged crime is terrible but it's made worse by the fact that Ford knew he was HIV-positive and could have passed the disease on to the unwilling woman. The suspect was indicted on Tuesday and a judge ordered him to be checked for venereal diseases. It's not clear if the student he's accused of abusing has also had tests done yet.

The trial is expected to be a difficult one for Ford's attorney, who has to cast doubt on the woman's story and the evidence. Jeff Adams plans to argue about the student's state of mind. "How is he to know she is sleepwalking, if it's a dream 'yes' or a real 'yes?'" Adams relates about her perceived consent.

That outrages prosecutor Seth Tieger, who counters anyone seeing her sleepwalking would have known she wasn't able to make an informed decision on anything - if Ford even asked the question. "It's not like she was carrying on a normal conversation," he responds.

The accused faces a large number of counts, including rape, kidnapping and felonious assault. If convicted he could go to jail for 46 years. Given his age, that's tantamount to life in prison.
