Officers Cleared In Killing Of Amber Alert Suspect
Prosecutor: Shooters Acted Responsibly

SEYMOUR, Ind. -- A county prosecutor has cleared police officers in the shooting that killed a man who was being sought in an Amber Alert issued last month after he fled with his 2-year-old daughter.

Jackson County Prosecutor Stephen Pierson issued a report Tuesday saying a state police trooper and two Seymour police officers acted responsibly in shooting Thomas J. Evans, 45, on April 27 and that no charges would be filed against them.

Police had issued the alert a day earlier for Andrea Evans after her mother reported that she had been bound and beaten by her husband, who then took their child from their home in the city midway between Indianapolis and Louisville, Ky.

After officers stopped Thomas Evans, who had his daughter inside his car, along Indiana 11 just north of Seymour, he ignored orders to drop his gun and pointed it at Seymour Officer Jennifer Johnson before police fired at him, Pierson said.

"I didn't find any inappropriate action by the police," Pierson said. "If Mr. Evans had just given up when asked, he could still be alive."

Johnson, Trooper Michael Bailey and Seymour Officer Ian McPherson fired 24 shots at Evans in a 17-second period, Pierson said.

Evans did not fire a shot, but investigators reported finding his handgun loaded and its hammer cocked.

"Three officers saw him raise his gun, and two additional officers saw him with the gun in his hand," Pierson said.
