Judge allows suit by man ‘fired’ after he was ‘mocked as Jew lover’

A Westchester County man who was tormented with insults of “Jew lover” at work after he married a Jewish woman can move forward with his wrongful-termination lawsuit, court papers state.

Jeffrey Chiara — who is not Jewish but is married to a Jewish woman — claims he was fired in 2007 from his job with the Town of New Castle because of anti-Semitism, according to the ruling issued by the Appellate Division’s Second Department.

His case was tossed out in 2012 by the state Supreme Court in White Plains, which ruled, “The contention by plaintiff, that he was . . . somehow discriminated against by the Town, based on his wife’s religion, is nothing more than conjecture.”

But the Second Department decision, revealed Wednesday, says Chiara raises triable issues of fact and notes: “The plaintiff’s allegations call to mind the infamous Nuremberg Laws enacted in 1935, which stripped German Jews of their civil rights.”

A lawyer for the town said Chiara was terminated because he’s a poor employee.
