A federal district court judge has cleared the way for Neo-Nazi Bill White to be released from jail.
Judge James Turk sided with a magistrate judge who had previously found White to not be a danger and eligible to be released on bond. Turk confirmed the $25,000 amount and terms of the bond. Prosecutors could still appeal to a U. S. Circuit Court judge to stop White's release.
On Tuesday, Turk ordered a local psychiatrist to examine White before he decided whether White should be released on bond. A defense psychiatrist who had previously examined White said he was not an imminent danger to the community, despite White's writings.
White faces charges in Virginia of threatening a syndicated newspaper columnist, a New Jersey mayor and several other people by e-mail, telephone or online.
White has been in custody since last October when he was arrested on a charge of encouraging violence against the foreman of a Chicago jury that convicted a fellow white supremacist.
A Chicago judge dismissed that charge in July on First Amendment grounds, and White was returned to Virginia.
White is the self-styled leader of the Roanoke-based American National Socialist Workers Party.
