George Thomas arrest in question; Lemaricus Davidson's fight to dismiss

In day two of a motions hearing to argue over the legality of George Thomas' arrest and his statements to police, a familiar name came up once again.

Two officers took the stand to talk about their conversations with Lemaricus Davidson's ex-girlfriend Daphne Sutton.

Sutton and Davidson were listed on the lease for 2316 Chipman Street. This information led investigators to Sutton, who apparently led them to four murder suspects.

In a 71-page transcript, Sutton told Knoxville Police Officer Ryan Flores that she had only known Davidson two weeks when they moved in together.

"I've been living with my parents for like a year and a half, and I really can't stand it. You know how it is, living with your parents. So I met him, and he was getting this house and asked me to move in with him, and I guess just the first person to take care of me I jumped into. I don't even date black guys, my kids are white, so I don't know what the hell I was thinking. I really don't. Maybe, I don't know, the drugs, the weed," Sutton told Flores.

Sutton told officers that Davidson's brother Letalvis Cobbins, and his friends Vanessa Coleman and George Thomas moved in, in December. She also pointed the finger at all four when officers asked her who was in the house on Sunday January 7, 2007.

Wednesday morning, Knox County Sheriff's Office Assistant Chief Robert Sexton told the court he took a copy of Thomas' driver's license to Sutton to identify.

Knoxville Police Investigator Ryan Flores also took the stand to talk about his lengthy interview with Sutton, who told officers that Thomas, Cobbins, and Coleman were brought to Knoxville from Kentucky by a woman named Stacey Lawson.

Sutton also told officers about Davidson's drugs and temper. "Cause I know he's snorting coke, and I think that morning that he snapped on me, that's why, because maybe he'd been out all night and wanted another hit of some crack or a line of some powder, and that's why he got so mad."

But there was not much she knew about Thomas or the guy she called "G". "He's got not really an afro, but his hair comes out a little bit. He always wears a black and tan letter jacket. It says something on the back."

However, the weekend Channon Christian and Chris Newsom were killed, Sutton was more descriptive about seeing Thomas in the house she shared with her boyfriend.

"He was sitting in the chair rolling up some weed. He didn't even look up though. He was just looking down the whole time," Sutton told officers.

Thomas, Letalvis Cobbins, and Vanessa Coleman were all taken into custody at Natasha Hayes' home in Lebanon, Kentucky on January 11, 2007.

Defense attorneys say Thomas' warrantless arrest was unlawful, and his statements to police should be thrown out. However, the prosecution says they had probable cause and the victims' families agree.

"They had probable cause," Chris Newsom's father Hugh Newsom said. "Paperwork was in place. There should be no question about suppressing his statement or anything else."

"They could detain him because of what they knew, and they did detain him. Good thing they did. You know he was about to try to go somewhere," Channon Christian's father, Gary said.

On Tuesday, ATF Special Agent Bernard Waggoner testified that Thomas' girlfriend Stacey Lawson told him she was going to pick up Thomas, Cobbins, and Coleman and get them out of Lebanon.

Judge Richard Baumgartner will make a decision in the coming weeks.

However, the victims' families aren't too worried about Thomas' fight to throw out his statements.

"It's all immaterial to me. Let's get on with the Davidson trial," Gary Christian said.

On Thursday morning, attorneys will argue about dismissing the charges against Lemaricus Davidson and new DNA evidence.

Davidson's attorneys say their client wrote a letter to them in April 2008 that was intercepted by corrections officers at the jail. The letter was given to the prosecution.

In a response filed by the prosecution on Wednesday, the state admitted that one incoming and three outgoing letters for Davidson were pulled. The letters were copied.

Prosecutors say they were not aware that one of the letters was addressed to Davidson's attorneys.

According to the response, the letter was scanned and given to all the defense attorneys. "No employees of the District Attorney's Office reviewed the letters at the time they were scanned."

The state also claims their strategy was not changed by the information in the letter.

The prosecutors also stated in the response that they did not know the intercepted letter was intended for Davidson's attorneys until October 7, 2009. "The contents of the letter were not reviewed by either prosecutor at the meeting and have not been reviewed since the meeting," prosecutors wrote.

The letter has been submitted to the court under seal.

Prosecutors wrote in their response to the court, "that dismissal of the indictment in this case would be highly inappropriate and insufficiently tailored given the interests at stake."

Another topic expected to be discussed on Thursday morning will be new DNA revealed by a Virginia lab.

Last week, Davidson's defense filed a motion indicating that Bode Technology found sperm from two unidentified men on Christian's underwear.

However, prosecutors are telling the victims' families that there is no confirmation that the DNA is sperm.

"If it was sperm, I want to know who's on it, I want to know who it belongs to, both of them," Gary Christian said.

"Because somebody else needs to be charged," Deena Christian added.

"The DNA evidence they want to discuss has nothing to do with the DNA we already have on Davidson," Deena Christian said.
