Accused Shooter May Not Stand Trial
After prosecutors thought they had a rock solid case, a local man may not stand trial for shooting someone and staging a standing with police.
Jose Barron, 26, allegedly shot a 31-year-old man at his home on Vera Cruz in May. Following the shooting, Barron reportedly staged a five-hour standoff with police, which finally ended when SWAT officers surprised him from behind.
Prosectuors said they can prove Barron was at the home at the time of the shooting. They also said they recoverd the shotgun he used from that house and can pin Barron with a motive.
But the open-and-shut case quickly turned problematic as their witness testimony fell apart.
The shooting victim has disappeared, and he did not testify. The victim's uncle, who originally identified Barron as the shooter, has retracted that statement in court.
The defense attorney has asked the judge to release the jurors and make a decision himself.
Without eyewitness testimony, though, the judge is trying to decide if there is enough factual evidence for anyone to decide Barron's innocence or guilt.
