Funny, he seems like the ultimate capitalist.

Tax lawyer Jay Arthur Goldberg — under investigation for making unexplained payments to Assembly Speaker Sheldon Silver — emerged from his house on Staten Island Wednesday wearing a military-style Russian hat with a hammer-and-sickle insignia.

Federal authorities are scrutinizing Goldberg because Silver, a lifelong pal, has been collecting payments from Goldberg’s law firm for about a decade without listing them on disclosure forms.

Goldberg didn’t have much to say about the situation.

“There was absolutely nothing illicit going on,” he told The Post. “ can’t say any more than that because there is an investigation going on.”

His attorney Michael Ross declined to comment, as did a spokesman for the speaker.

Silver is expected to be re-elected easily next week for his 11th term as speaker despite new questions about what he does to earn his outside income.

In 2013, Silver reported taking in $650,000 to $750,000 in addition to his legislative salary of $121,000, mostly from the personal-injury law firm of Weitz & Luxenberg.

Silver, who is a personal-injury lawyer himself, has refused to explain the deal he has with Goldberg’s two-member firm, Goldberg & *Iryami P.C., which specializes in property-tax challenges.

Some Republican critics are calling for Silver to resign — or for another Democrat to step up as speaker.

“This is going to be an interesting vote,” said Assemblyman Steve McLaughlin (R-Troy). “There’s 43 of us who would absolutely throw our votes to anybody else we could choose, and there are 36 of them who we need, but I don’t think they’re going to do that.”

There are 150 members in the Assembly, with Democrats holding a 2-to-1 edge.

Silver’s Democratic allies say he’s not going anywhere except back to his leadership post.

“I think members will stick with Shelly,” said Assemblyman Joe Lentol (D-Brooklyn).

“It’s hard for me to believe Shelly would do anything that is incorrect and especially unlawful. Everybody makes mistakes.”

Gov. Cuomo declined to offer his assessment of Silver, who has a strained relationship with the governor.

Cuomo said he knew only “what I read in the newspaper” and would not speculate on Silver’s future.

“The decisions will be left to the speaker and the Assembly,” Cuomo said.
