Spain Announces Crimes Against Humanity Investigation for 2002 Gaza Bombing by Israel

Madrid - Spain's National Court on Thursday launched an investigation into a 2002 Israeli attack in the Gaza Strip, naming then defence minister Benjamin Ben-Eliezer and six army officers or security officials as suspects in a crime against humanity. Judge Fernando Andreu announced he accepted to investigate a complaint lodged by the Gaza-based NGO Palestinian Centre for Human Rights.

Israel dropped a one-ton bomb into a Gaza City neighbourhood housing Hamas leader Salah Shehade on July 22, 2002. Shehade and 14 civilians were killed in the attack, and dozens were injured.

Judge Andreu described the attack as "disproportionate" in his ruling.

An attack against civilians was illegitimate to start with, and could be regarded as an assassination, on which grounds the Spanish judiciary had jurisdiction over the case, basing it on the principle of universal justice, Andreu argued.

Andreu will request the Palestinian authorities to arrange for witnesses of the attack to be questioned, and Israel to inform the suspects of the judicial proceedings concerning them, the judge said.

Andreu said he had earlier requested information from Israel on whether the attack was being investigated, but received no reply.

Spain's National Court has investigated alleged human rights violations around the world, especially in Latin America.

Doubt this will reach anything, but at least you can't blame Spain for trying...
