Quebec racist website returns to internet

A racist website that shut down Sunday night after a complaint to the Canadian Human Rights Commission returned to the internet less than a day later in a more vitriolic form.

The site, called "Dossier Noir," was originally based in Quebec and targeted black Canadians, calling them criminals.

In its new form, the site contains anti-Semitic content.

The man who now runs it, a U.S. neo-Nazi named Bill White, put the name and address of a Canadian human rights lawyer who fights against hate on the website.

The Canadian Jewish Congress has been hoping to see White silenced for years, but he has been protected by U.S. free-speech laws.

The CJC said White is clearly counselling violence and they hope U.S. authorities will finally arrest him.

Earlier this month, the Centre for Research-Action on Race Relations filed a complaint with the Canadian Human Rights Commission about the website, which published the addresses of a group of men accused in connection with an alleged gang rape.

The Canadian Radio-television and Telecommunications Commission is reviewing an application filed by an Ottawa human rights lawyer who’s been the target of death threats in the United States.

In an affidavit filed in court in Toronto, Richard Warman said actions by a “notorious” Virginia neo-Nazi have caused him to fear for his life.

Posts on two U.S.-based websites call for the “violent overthrow” of the Canadian government and the “extermination” of Jews in Canada.

Although the sites are beyond the reach of Canadian law, the CRTC has the rarely used power to order Internet providers to temporarily block them from Canadian web surfers.

White has encouraged people to “take violent action” against the lawyer and even posted his home address on the site.

It’s believed to be the first time the CRTC has been asked to block Canadian access to a foreign website, said telecommunications industry consultant Mark Goldberg.

“This is precedent-setting work,” said Goldberg, who is also a member of the Ontario executive of the Canadian Jewish Congress.

Bernie Farmer, the CJC’s chief executive officer, said White has crossed “all kinds of legal lines” in inciting violence against Warman.

“We’re not dealing with a free speech issue here, we’re dealing with what I believe is a criminal matter -- somebody counselling other people to go ahead and murder somebody,” Farber said.

White is protected in the U.S. by free speech laws.

Goldberg said he’s had a positive response from Canadian Internet carriers about blocking the site if the CRTC gives its blessing.

Goldberg acknowledged that blocking the URL — the address typed into a browser to access the website -- won’t prevent the content from popping up somewhere else.

But he said a ruling would put a “speed bump” in the ability of a person to distribute hate material.

“Once we have precedence, hopefully it will be a reasonable process to say, `This is the same site that just changed its name.”’

Ottawa, Canada -- The Canadian Radio-Television and Telecommunications Commission today refused to grant a request by Jewish hatemonger Richard Warman to ban this website in Canada, stating that "Such a public process would allow for consideration of the broader policy and legal issues regarding the scope, and appropriate use, of the commission's powers."
Bernie Farber, head of the Canadian Jewish Congress, which had been backing Warman's suit, responded that:

"I think it's very disconcerting that a Canadian citizen can become the subject of a murder warrant and there doesn't seem to be any procedures in place by the government body that regulates the Internet to in any way intercede on his behalf."

The Canadian Press reported that Warman has fled the country and gone "into hiding" because he fears Canadians angry at his acts of political repression are imminently about to attack him at his home.

The Canadian Jewish Congress told the press that they will "resubmit" their application in the near future.

The Canadian Jewish Congress and Richard Warman have repeatedly attempted to censor White over the past three years, filing numerous complaints against him with US authorities and threatening civil suits for "libel" against him in Canada. However, US and Canadian speech laws are so different, and White, a self-made millionaire, is so well funded with attorneys, that they have made zero headway against him, despite repeated and often ingenious legal efforts.

TORONTO (CP) - Canada's telecommunications regulator has rejected a bid by an Ottawa lawyer to block access to two U.S.-based hate websites that call for the "violent overthrow" of the Canadian government and the "extermination" of Jews in this country.

In an application filed to the Canadian Radio-television and Telecommunications Commission on Monday, Richard Warman said websites by a Nazi sympathizer contain material intended to incite violence against him that has caused him to fear for his life.

The application to the CRTC described Bill White of Roanoke, Va., as a neo-Nazi who has encouraged people to "take violent action" against Warman and even posted his home address on the sites.

Warman argued the websites communicate hate and advocate genocide, which are offences under the Criminal Code.

Although the sites are beyond the reach of Canadian law, the CRTC has the rarely used power to order Internet providers to temporarily block them from Canadian web surfers.

But the regulatory body must first issue an interim order allowing Internet carriers to do so voluntarily.

On Thursday, the CRTC said the unprecedented nature of Warman's request raises "serious and fundamental issues."

In a letter to the law firm representing Warman, the commission said it would be inappropriate to consider granting the interim order without first giving Internet carriers and other interested parties the opportunity to comment.

"Such a public process would allow for consideration of the broader policy and legal issues regarding the scope, and appropriate use, of the commission's powers," wrote secretary-general Diane Rheaume.

Bernie Farber, chief executive officer of the Canadian Jewish Congress, said he's disappointed in the decision because of what he considers the "considerable danger" to Warman.

"Procedure seems to have trumped the safety of a Canadian citizen here," Farber said.

"I think it's very disconcerting that a Canadian citizen can become the subject of a murder warrant and there doesn't seem to be any procedures in place by the government body that regulates the Internet to in any way intercede on his behalf."

The congress will be looking at re-submitting its application, as well as other avenues with the CRTC, Farber said.

Warman was outside of the country and unable to comment on Friday.

One of the websites, hosted by Google's weblog service Blogger, was taken offline Wednesday.

"We want Blogger to enable free expression, including the hosting of views and opinions that are unpopular," Google spokesman Steve Langdon said.

"However, advocating violence against a person is not acceptable."
